1. Definitions
For the purpose of this Agreement:
“Chamal Estate”, “We”, “Us”, “Our”: operator of chamalestate.com.
“Platform” or “Website”: chamalestate.com and all related services.
“User”: any person or entity using the Platform.
“Agent”: an individual real estate professional.
“Agency”: a real estate company managing one or more Agents.
“Service Provider”: any professional offering services through the Platform.
“Property Seeker”: users searching for properties or services.
“Listing”: any property or service posted on the Platform.
“Featured Listing”: a listing with enhanced visibility.
“Lead”: any inquiry or message submitted through the Platform.
“Subscription” / “Plan”: paid monthly or yearly membership.
“AI Tools”: all artificial intelligence features provided by the Platform.
“Content”: any text, images, documents, or data uploaded by Users.
“Third-Party Services”: external systems the Platform relies on (Stripe, PayPal, hosting, AI providers, email services, etc.).
2. Acceptance of Terms
By accessing or using chamalestate.com, Users agree to be legally bound by these Terms & Conditions.
If you do not agree, you must not use the Platform.
Chamal Estate may modify these Terms at any time.
3. Purpose of the Platform
3.1. Chamal Estate is an online technology platform, not a real estate agency.
3.2. Chamal Estate does not verify, guarantee, or broker real estate transactions.
3.3. All interactions between Users occur independently of Chamal Estate.
3.4. The Platform provides tools for listing, visibility, lead forwarding, and AI-assisted functions.
4. User Accounts
4.1. Users must provide accurate and current information.
4.2. Chamal Estate may request verification at any time.
4.3. Accounts may be suspended or terminated for:
fraud
duplicate accounts
misuse
illegal behavior
misleading information
violating these Terms
non-payment
suspicious activity
4.4. The User is responsible for protecting login credentials.
4.5. All actions under the User’s account are their responsibility.
5. Subscriptions, Payments & Renewals
5.1. Subscription plans include varying limits, such as:
number of listings
number of featured listings
access to leads
access to AI Tools
5.2. Accepted payment methods:
Stripe
PayPal
Bank Transfer
5.3. Subscriptions renew automatically unless canceled before the renewal date.
5.4. All payments are final and non-refundable.
5.5. Chamal Estate may change pricing with notice.
6. Cancellation, Non-Payment & Hidden Listings
6.1. What Happens When a Payment Fails or a Subscription Ends
If a User cancels or fails to pay:
Listings become hidden / inactive.
Leads are no longer delivered.
AI tools become inaccessible.
Account access remains limited to billing & settings.
Listings are not deleted immediately, however they may be permanently removed if:
they violate policies,
they are fraudulent,
they are duplicates,
they contain misleading information,
the User remains inactive beyond retention limits.
6.2. Data Retention
Chamal Estate may delete accounts and all associated data after 6 months of inactivity.
6.3. Liability
Chamal Estate is not responsible for any data loss due to non-payment or inactivity.
7. Listings — Requirements & Restrictions
7.1. Users are fully responsible for the accuracy and legality of their listings.
7.2. Users confirm they own or have rights to all images, text, and materials submitted.
7.3. Listings must be truthful, up-to-date, and non-deceptive.
7.4. Forbidden Content
Listings may not include:
false or misleading information
illegal content
stolen or copyrighted material
inappropriate or harmful content
7.5. Duplicate Listings Prohibited
Users may not publish the same property more than once.
Duplicate listings can be removed without notice.
Repeated violations may lead to termination.
7.6. Right to Remove Any Listing
Chamal Estate may remove or disable any listing for:
violation of Terms
user reports
suspicion of fraud
quality control
protecting Platform integrity
any reason at our discretion
Chamal Estate is not liable for losses caused by listing removal.
8. Leads, Inquiries & Communication
8.1. Leads are forwarded to Users based on their subscription.
8.2. Chamal Estate does not guarantee:
lead quantity
lead quality
lead accuracy
conversion rate
identity or seriousness of the inquirer
8.3. Chamal Estate is not responsible for:
missed messages
delayed notifications
user-to-user communication issues
9. INFORMATION TRANSFER TO AGENTS, AGENCIES & SERVICE PROVIDERS
9.1. Consent to Information Transfer
By sending any lead, message, or inquiry through chamalestate.com, the User explicitly authorizes Chamal Estate to transfer all provided information to the relevant Agent, Agency, or Service Provider.
This includes, without limitation:
full name
email address
phone number
message content
inquiry details
listing reference
attachments
any voluntary or optional data submitted
metadata needed for routing
9.2. Independent Data Controllers
Once transferred, the receiving Agent, Agency, or Service Provider becomes an independent data controller and is fully responsible for the use, storage, and protection of the information.
9.3. Chamal Estate Liability Shield
Chamal Estate is not responsible for:
how third parties store or use the information
unwanted contact
misuse or abuse of data
failure to respond
inaccurate responses
any communication or agreement formed afterward
9.4. If the User Does Not Agree
If a User does not want their information shared, they must not use the contact or inquiry features of the Platform.
10. AI Tools — Disclaimer & Limits
Users acknowledge:
10.1. AI Output May Be Incorrect
AI may generate inaccurate, incomplete, irrelevant, or misleading outputs.
10.2. AI Is Not Advice
AI output does not constitute:
legal advice
financial advice
valuation advice
real estate advisory
negotiation advice
10.3. User Responsibility
Users must verify and review all AI-generated content.
10.4. No Liability
Chamal Estate is not responsible for:
wrong lead classification
incorrect translations
wrong insights
inaccurate AI-generated marketing content
10.5. AI Provided “As Is”
No warranties or performance guarantees are given.
11. Third-Party Services
Chamal Estate uses third-party services such as:
Stripe
PayPal
Hosting providers
Email providers
WhatsApp APIs
AI engines
Chamal Estate is not responsible for outages, failures, or data breaches caused by third-party systems.
12. Intellectual Property
12.1. Users retain ownership of their content.
12.2. Users grant Chamal Estate a license to display and use the content on the Platform.
12.3. Chamal Estate owns all:
branding
design
AI systems
platform code
database structure
12.4. Users may NOT:
scrape data
copy platform features
reverse engineer systems
misappropriate content
13. Privacy & Data Protection
Chamal Estate follows Moroccan law regarding data protection.
We do not sell user data.
We process information only for platform functionality, safety, and legal obligations.
14. Prohibited Activities
Users may not:
engage in fraud
post misleading or duplicate listings
impersonate others
spam or harass
upload harmful content
extract platform data
automate unauthorized tasks
15. Limitation of Liability
Chamal Estate is NOT liable for:
indirect or consequential damages
lost income or opportunity
listing errors
AI errors
user disputes
missed leads
data loss
downtime
Maximum liability is limited to the amount paid in the last 30 days.
16. Indemnification
Users must indemnify and hold harmless Chamal Estate from all claims arising from:
their listings
their communications
their misconduct
disputes with third parties
misuse of AI tools
17. Account Termination
Chamal Estate may terminate accounts immediately for violations of these Terms.
No refunds will be issued.
18. Governing Law
These Terms are governed by Moroccan law.
Disputes are handled exclusively by the courts of Tetouan, Morocco.
